(ONLINE) CONTENT – Terms of Use

In addition to the General Terms and Conditions (shown above), the provisions set out in this section shall apply when you use or browse any website owned or operated by Coaches Rising (either directly or indirectly), including www.coachesrising.com and www.courses.coachesrising.com (collectively, the “Site”). By using or browsing the Site or accessing any User Content while using or browsing the Site, you acknowledge that you have read, understood and agree to be bound by these User Terms and Conditions and all applicable laws and regulations.

YOU AGREE THAT BY USING THIS SITE, YOU ARE AT LEAST 18 YEARS OLD, OR, IF LESS THAN 18 YEARS OLD, THAT YOU HAVE THE CONSENT OF A PARENT OR GUARDIAN TO USE THIS SITE, AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THIS AGREEMENT.

It is your responsibility to review these Terms and Conditions periodically, and if at any time you find these Terms and Conditions unacceptable, you must immediately leave the Site and cease all use of the Site or any User Content.

Coaches Rising may change these Terms and Conditions at any time and without any notice to you so we suggest that you periodically visit this page to review these Terms and Conditions. By using this Site after we post any changes, you agree to accept those changes, whether or not you actually reviewed them. These Terms and Conditions shall prevail in the event of any discrepancy between them and the provisions of the General Terms and Conditions of Coaches Rising.

Where these Terms and Conditions refer to a “Customer”, such reference shall also include a “User” or “Client”, as those terms are defined in the General Terms and Conditions.

Article 1. Site Contents

This Site and its contents are determined solely by Coaches Rising. All materials on this Site, including, but not limited to, the Online Content, the design, the texts, logos, images and the method of composition (collectively, the “Contents”), are owned exclusively (either directly or indirectly) by Coaches Rising and/or its Content providers. The Contents are protected by and subject to the copyright or the intellectual property rights of Coaches Rising or its Content providers.
Any marks, logos and designs appearing on the Site are the exclusive trademarks of Coaches Rising. Expect where otherwise indicated on this website or in the Information, no license to or right in any such marks, logos, or designs and other proprietary rights of Coaches Rising is granted to or conferred upon you.

Except where otherwise indicated on this website or in the Information, you may consult this website and the Online Content and make copies thereof for his own use, for example by printing or saving them. Any other use of the Site or right not expressly granted to you in these Terms or Conditions is expressly reserved for Coaches Rising, and is only permitted with the prior written consent of Coaches Rising.

Article 2. Information & Third-Party Content

The Site and its Contents are maintained with the utmost care. Nevertheless, Coaches Rising cannot guarantee that the information on the Site and Content is always complete, correct or up to date. The Information is only intended solely as a source of information and is not intended as advice. Coaches Rising cannot guarantee that the Online Content does not infringe the intellectual property rights of third parties or is otherwise unlawful towards third parties.
Any Content on the Site originating from third parties only reflects the personal opinion of those third parties. Coaches Rising is not responsible for this Content and accepts no liability for it. Links on this Site may lead to services or sites not controlled or operated by Coaches Rising. Coaches Rising provides these links for your convenience and information. Links are not an endorsement of the third party’s site or content. Coaches Rising assumes no responsibility or liability for other sites or services. Any use you make of any site or service linked to by this Site is entirely at your own risk.

Article 3. Use of the Site & Online Conduct

The Site and Content only grant to you those functionalities that are explicitly stated in the Offer (as set forth in the General Terms and Conditions). Coaches Rising bears no liability for the absence of functionalities that are not expressly stated in the Offer. Any other use of the Site or the Contents is strictly prohibited, including, without limitation, modification, removal, deletion, transmission, publication, distribution, proxy cashing, uploading, posting, redistribution, re-licensing, selling, duplicating, republication or any other dissemination without the express written permission of Coaches Rising. You may not use any framing techniques to enclose any trademarks, logos, or designs of Coaches Rising, nor use any meta tags or other hidden text without Coaches Rising’s prior written consent. You may not link to the Site without Coaches Rising’s prior written consent. Use of spiders, robots and similar data gathering and extraction tools is expressly prohibited.
In the event that you can independently add content to the Site (“User Content”), Coaches Rising is not responsible for the legality, correctness, or completeness of your User Content, even if this content is added by Coaches Rising on your initiative. You will not be compensated for any User Content. Coaches Rising bears no liability for any damage or claims of third parties in any connection with any User Content. In this regard, the party on whose initiative content is added to the platform is responsible for uploading, managing, storing and using this content without infringing copyrights and other intellectual property rights of third parties. Such party shall indemnify Coaches Rising against all claims from third parties in this respect. By adding, or causing to be added, and User Content, you:

Grant Coaches Rising, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the business of Coaches Rising, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, reformat, and delete User Content;
Grant Coaches Rising the right to use your name, image, likeness, and voice in still photos, slides, video, voice recorded productions, radio coverage, television coverage and/or any other media, now and in the future, for the purpose of promoting, advertising, and marketing Coaches Rising and its services, if any such information is included in User Content. You waive all claims against Company for such use;
Agree that Coaches Rising may publish or otherwise disclose your name and location in connection with your User Content; and
Warrant and represent that You own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content.

You agree to use the Site only for lawful purposes. Behaviour that can be qualified as abuse is strictly prohibited, as is posting or transmitting to or through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful material, or any other material that could give rise to civil or criminal liability under the law. This includes violating any (intellectual) property rights of Coaches Rising or third parties, the distribution of secret or confidential information, the improper, unlawful or punishable distribution of texts, criminal data traffic and unlawful breaches of the systems of which the services of Coaches Rising is dependent, including the spread of viruses, worms, etc.
You may not misuse the Site so as to intentionally, recklessly, or gross negligently cause malfunctions or defects in the Content, Site or servers of Coaches Rising or any other third parties. You may not make contributions of a commercial nature and you do not send solicited or unsolicited advertisements. You may not post or send any data or material or upload any hardware that spreads viruses or other (harmful) programs or computer software, to cause a (negative) effect on the functioning of the computer software.
Coaches Rising, in its sole discretion, shall determine whether these Terms and Conditions have been violated.
Coaches Rising is not responsible for the content of contributions posted by users of the website. Coaches Rising reserves the right to remove contributions at any given time without giving a reason.
After termination of your right of use, you must cease and desist all use of the Site and Content. All copies, including backup copies of the Content, must be removed from your systems at such time and either returned to Coaches Rising or destroyed.
The rights under these Terms and Conditions and the General Terms and Conditions are not transferable to any third party. You are not permitted to make any usernames and passwords used on the Site available to third parties, even if those third parties use the Site exclusively for your benefit.
You are responsible for putting the Site and Content into operation. The platform is web-based. You is only entitled to personal support from Coaches Rising for your use of the Site or Contents insofar as this has been expressly agreed upon in writing by Coaches Rising.
You shall use the platform at all times in accordance with the instructions supplied or made available to you. You are deemed to know or be able to know that improper use of the Site may cause damage, for which you bear liability, without prejudice to Coaches Rising’s right to hold the person causing the damage also responsible.
If Coaches Rising has secured the Site by means of technical measures, you are not permitted to remove, modify or bypass this protection.

Article 4. Disclaimer of Warranties; Limitations of Liability

THIS SITE AND ITS CONTENTS ARE PROVIDED BY COACHES RISING “AS IS” AND “AS AVAILABLE” WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND WHETHER EXPRESS OR IMPLIED. COACHES RISING EXPRESSLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN NO EVENT WILL COACHES RISING BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, COMPENSATORY, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES OF ANY KIND WHATSOEVER, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY, BUSINESS INTERRUPTION, OR LOSS OF PROGRAMS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THIS SITE, ANY SITE OR SERVICES LINKED THROUGH THIS SITE, OR ANY COPYING, DISPLAY OR USE THEREOF, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, EVEN IF COACHES RISING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES THAT RESULT FROM ANY MISTAKE, OMISSION, VIRUS, DELAY OR INTERRUPTION IN OPERATION OR SERVICE REGARDLESS OF THE REASON. COACHES RISING WILL NOT BE LIABLE FOR LOSSES OR DAMAGES ARISING OUT OF OR ANY WAY RELATED TO ANY THIRD-PARTY WEB SITES OR THEIR CONTENT ACCESSED THROUGH LINKS IN THIS SITE, YOUR USE OF THIS SITE OR YOUR USE OF ANY EQUIPMENT OF SOFTWARE IN CONNECTION WITH THIS SITE.
Certain laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply but liability shall be limited to the fullest extent permitted by law.

Article 5. Expenses & Indemnification

Any damage and/or costs incurred by you as a result of using this Site or the Content shall be for your own account.

Coaches Rising and its affiliated parties (including but not limited to its employees, directors, affiliated organizations, or other representatives) shall not be held responsible for any loss or damage that results directly or indirectly from your use of the Site or Content, including the facilities or services offered through this website. You agree to indemnify and hold harmless Coaches Rising from any third party claim, action, demand, loss or damage (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms and Conditions, your use of the Site, or your violation of any rights of any third party. In the event that the aforementioned exclusion of liability is not upheld in law in whole or in part, the liability of Coaches Rising and its affiliated parties (including but not limited to its employees, directors, affiliated organizations or other representatives) shall in all cases be limited to the amount that you have paid for use of the Content, with a maximum of 900 U.S. dollars ($900.00).

Article 6. Suspension and termination

Coaches Rising reserves the right to terminate your use of the Site or its Contents in its sole discretion. To ensure that Coaches Rising provides a high quality experience for you and for other Users of the Site and the Service, you agree that Coaches Rising or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Site. Coaches Rising reserves the right not to disclose the existence or occurrence of such an investigation unless required by law, but Coaches Rising reserves the right to suspend or terminate your account or your access to the Site immediately, with or without notice to you, if Coaches Rising believes that you have violated any of the Terms of Use, furnished Coaches Rising with false or misleading information, or interfered with use of the Site by others.

Article 7. Miscellaneous

If any provision of these terms and conditions of use proves to be wholly or partly void, is annulled or otherwise proves to be invalid, the validity of the remaining provisions of these User Terms and Conditions shall not be affected. The provisions that are not legally valid or cannot be applied by law will be replaced by provisions that are as close as possible to the intent of the provisions that are void.
This Site and the Contents are displayed solely for the purpose of promoting Coaches Rising’s available services. These User Terms and Conditions are exclusively governed by Dutch law, without regard to any conflicts of laws provision thereof. You are responsible for complying with the laws of the jurisdiction from which you are accessing this Site, and you agree that you will not access or use the information on this Site in violation of such laws. Coaches Rising’s failure to enforce any rights under these Terms and Conditions will not constitute a waiver of any terms or conditions of these Terms and Conditions. In the event of any dispute between you and Coaches Rising arising out of these Terms and Conditions, the court of the district (in the Netherlands) where Coaches Rising has its registered office has exclusive jurisdiction to settle any such disputes.
These Terms and Conditions are originally written in the English language and shall be governed by the English language. In the event any dispute arises with respect to this Agreement, the meanings of all terms and provisions shall be interpreted in their English form. The governing language of all correspondence related to reporting, negotiation, disputes, and notice requirements shall be the English language. Any translations of these Terms and Conditions are provided for convenience only and shall have no legal force or effect.

De in dit onderdeel vermelde bepalingen zijn, naast de Algemene Voorwaarden (hiervoor weergegeven) van toepassing wanneer je gebruik maakt van een website die eigendom is of wordt gebruikt door Coaches Rising (zowel direct als indirect), waaronder www.coachesrising.com en www.courses.coachesrising.com (hierna collectief “Website”). Door gebruik te maken van de website of kennis te nemen van de Online Content, erken je dat je de deze Gebruikersvoorwaarden hebt gelezen, hebt begrepen en dat je gebonden bent aan de Algemene voorwaarden, de Gebruikersvoorwaarden en alle relevante wetsartikelen.

OM GEBRUIK TE MOGEN MAKEN VAN DE WEBSITE MOET JE TENMINSTE 18 JAAR OUD ZIJN OF BESCHIKKEN OVER DE TOESTEMMING VAN EEN OUDER OF VOOGD. DOOR GEBRUIK TE MAKEN VAN DE WEBSITE ERKEN JE AAN DEZE VOORWAARDE TE VOLDOEN.

Het is je eigen verantwoordelijkheid om regelmatig kennis te nemen van Algemene Voorwaarden en de Gebruikersvoorwaarden. Wanneer je je niet kan verenigen met de inhoud van deze beiden voorwaarden, dan dien je het gebruik van de Website en haar Online Content direct te staken.

Coaches Rising is gerechtigd de Algemene Voorwaarden alsmede de Gebruikersvoorwaarden te allen tijde wijzigen zonder de Gebruiker daarover te informeren. Coaches Rising raadt derhalve aan om regelmatig kennis te nemen van de Algemene Voorwaarden alsmede de Gebruikersvoorwaarden. Indien de Algemene Voorwaarden of de Gebruikersvoorwaarden zijn gewijzigd, en de Gebruiker na doorvoering van de wijzigingen, gebruikt maakt van de Website en de Online Content, dan wordt de Gebruiker geacht akkoord te gaan met deze wijzigingen (ongeacht of Gebruiker daadwerkelijk kennis heeft genomen van deze wijzigingen).

De Gebruikersvoorwaarden prevaleren in het geval van discrepantie tussen de bepalingen van de Gebruikersvoorwaarden of de Algemene Voorwaarden.

Waar in de onderstaande bepalingen wordt gesproken over “Afnemer” wordt hieronder tevens de “Gebruiker” of “Cliënt verstaan.

Artikel 1. Website Content

De Website en haar Online Content zijn uitsluitend bedoeld voor gebruik door Coaches Rising. Alle materialen van en op deze Website, zoals maar niet uitsluitend, de Online Content, het ontwerp, de inhoud, de teksten, de logo’s, de afbeeldingen en de wijze van samenstelling (collectief de Inhoud) vallen direct of indirect onder het auteursrecht dan wel de intellectuele eigendomsrechten van Coaches Rising of haar licentiegevers.
Alle merken, afbeeldingen, ontwerpen en logo’s op de Website zijn onderdeel van het exclusieve merkrecht van Coaches Rising. Indien niet anders is aangegeven op de Website of in de informatie, dan heeft Coaches Rising geen licentie of (eigendoms-)recht op dergelijke merken, logo’s of ontwerpen aan u verleend.
Behalve waar anders aangegeven op deze website of in de Informatie, mag de Afnemer deze website en de Online Content raadplegen en daarvan kopieën maken voor eigen gebruik, bijvoorbeeld door deze te printen of op te slaan. Ieder ander gebruik van deze website of de Online Content dat niet expliciet is goedgekeurd, is slechts toegestaan met voorafgaande schriftelijke toestemming van Coaches Rising.

Artikel 2. Informatie en inhoud van derden

De websites en de Online Content van Coaches Rising worden met de grootst mogelijke zorgvuldigheid bijgehouden. Desondanks kan Coaches Rising niet garanderen dat deze websites en de daarop gepubliceerde Informatie en de Online Content steeds volledig, juist of actueel zijn. De Informatie is uitsluitend bedoeld als bron van informatie en niet bedoeld als advies. Coaches Rising kan er niet voor instaan dat de Online Content geen inbreuk maakt op de intellectuele eigendomsrechten van derden of anderszins onrechtmatig is jegens derden.
Alle Online Content op de Website die afkomstig is van derden geeft uitsluitend de persoonlijke mening weer van de betreffende derden. Coaches Rising is niet verantwoordelijk voor de inhoud van deze Informatie en aanvaardt daarvoor geen aansprakelijkheid.

Artikel 3. Gebruik van de Website & online gedrag

Het platform kent uitsluitend die functionaliteiten die uitdrukkelijk in het aanbod danwel de Algemene Voorwaarden, zijn vermeld. Voor de afwezigheid van niet uitdrukkelijk in het aanbod vermelde functionaliteiten van het platform draagt Coaches Rising geen enkele aansprakelijkheid. Ander gebruik van de Website of de Online Content zoals (niet limitatief) wijziging, verwijdering, verzending, publicatie, distributie, proxy-cashing, uploaden, posten, herverdeling, herlicentieren, verkopen, dupliceren, herpublicatie of enige andere verspreiding zonder de uitdrukkelijke voorafgaande schriftelijke toestemming van Coaches Rising is niet toegestaan. U mag geen frametechnieken gebruiken om handelsmerken, logo’s of ontwerpen van Coaches Rising over te nemen, en u mag geen metatags of andere verborgen tekst gebruiken zonder uitdrukkelijke voorafgaande schriftelijke toestemming van Coaches Rising. U mag niet naar de Website linken zonder voorafgaande schriftelijke toestemming van Coaches Rising. Het gebruik van spiders, robots en soortgelijke tools voor het verzamelen en extraheren van gegevens is uitdrukkelijk verboden.
In het geval het mogelijk is om zelfstandig content toe te voegen aan het platform (“Gebruikers Content”), is Coaches Rising niet verantwoordelijk voor de rechtmatigheid, juistheid en volledigheid van de middels het platform door de Afnemer toegevoegde content, ook niet indien deze content op initiatief van de Afnemer is toegevoegd door Coaches Rising of door de Afnemer zelf op basis van de adviezen of instructies van Coaches Rising. Voor alle schade of aanspraken van derden in enig verband met aan het platform door of namens de Afnemer toegevoegde content, draagt Coaches Rising geen enkele aansprakelijkheid. Ter zake draagt de partij op wiens initiatief content aan het platform wordt toegevoegd de verantwoordelijkheid dat zij deze content zonder inbreuk op auteursrechten en andere rechten van intellectuele eigendom van derden, middels het platform mag uploaden, beheren, bewaren en gebruiken. Zij vrijwaart Coaches Rising van alle aanspraken van derden ter zake. Voor het overige zal Afnemer geen misbruik maken van de diensten van Coaches Rising en zich onthouden van het (doen) verspreiden van verboden en/of onrechtmatige content. Door Gebruikers Content toe te voegen of te laten voegen:

Verkrijgt Coaches Rising en aan haar gelieerde partijen (waaronder maar niet uitsluitend haar werknemers, bestuurders, gelieerde organisaties of andere vertegenwoordigers)
een licentie danwel het recht om deze Gebruikers Content te gebruiken voor haar bedrijfsvoering. Dit recht is inclusief maar niet beperkt tot een recht om te kopiëren, verspreiden, verzenden, openbaar weergeven, Gebruikers Content openbaar maken, reproduceren, bewerken, vertalen, opnieuw formatteren en verwijderen;
Verkrijgt Coaches Rising het recht de inhoud van de Gebruikers Content, zoals uw naam, beeld, gelijkenis en stem te gebruiken in stilstaande foto’s, dia’s, video, spraakopnames, radio-opnames, televisieopnames en / of andere media, nu en in de toekomst, voor de doel van promotie, advertentie en marketing van Coaches Rising en al haar diensten. U doet afstand van alle claims tegen Coaches Rising voor dergelijk gebruik.
Verkrijgt Coaches Rising het recht om de naam en locatie van de Gebruiker openbaar te maken;
Garandeert de Gebruiker dat zij de rechten bezit van de Gebruikers Content danwel dat zij geautoriseerd is om de Gebruikers Content te plaatsen, verspreiden, weergeven, uitvoeren, verzenden of anderszins te verspreiden.

Gebruiker zal de Website en de Online Content enkel gebruiken voor legale doelen. Tot misbruik te kwalificeren gedrag is ten strengste verboden, evenals het posten of verzenden naar of via de site van onwettig, schadelijk, bedreigend, beledigend, intimiderend, lasterlijk, vulgair, obsceen, godslasterlijk, hatelijk materiaal of ander materiaal dat wettelijk verboden is of waarvoor je civielrechtelijk aansprakelijk kan worden gesteld. Hieronder valt het schenden van (intellectuele) eigendomsrechten van Coaches Rising of derden, de verspreiding van geheime of vertrouwelijke informatie, het onrechtmatig, onrechtmatig of strafbaar verspreiden van teksten, crimineel dataverkeer en onrechtmatige inbreuken op de systemen waarvan de dienstverlening van Coaches Rising afhankelijk is, inclusief de verspreiding van virussen, wormen, enz.
De Gebruiker mag de Website niet gebruiken op een wijze dat zulks bewust of onbewust leidt tot storingen of defecten betreffende de inhoud, de Website of de servers van Coaches Rising (of derde partijen). U mag tevens geen bijdragen van commerciële aard plaatsen of gevraagde of ongevraagde reclame versturen. U plaatst of verzendt geen gegevens of materiaal dat virussen of andere (schadelijke) programma’s of computersoftware verspreidt. Zulks geldt eveneens voor het uploaden en voor hardware.
Coaches Rising bepaalt of de omgangsvormen en Gebruikersvoorwaarden zijn overtreden. Zij is hierover geen enkele verantwoording verschuldigd aan de Afnemer of aan derden.
Coaches Rising is niet verantwoordelijk voor de inhoud van bijdragen die worden geplaatst door gebruikers van de website. Coaches Rising behoudt zich het recht voor om bijdragen zonder opgave van reden en bijdragen op elk gewenst moment te verwijderen.
Na beëindiging van het gebruiksrecht van de Afnemer dient zij elk gebruik van de Website en de Online Content te staken en gestaakt te houden. Alle kopieën, waaronder reservekopieën dienen te worden verwijderd van de systemen van de Afnemer door deze terug te leveren aan Coaches Rising of door deze te vernietigen.
De rechten uit de overeenkomst zijn voor de Afnemer niet overdraagbaar. Het is de Afnemer niet toegestaan gebruikersnamen en wachtwoorden ter beschikking te stellen van derden, ook niet indien die derden het platform uitsluitend ten behoeve van de Afnemer gebruiken.
De Afnemer zijn zelf verantwoordelijk voor de ingebruikname van het platform. Het platform is “web-based”. De Afnemer maakt enkel aanspraak op persoonlijke ondersteuning bij het gebruik van het platform voor zover dat uitdrukkelijk is overeengekomen.
De Afnemer verplicht zich ertoe het platform te allen tijde in overeenstemming met de daarbij geleverde of beschikbaar gestelde instructies te gebruiken. De Afnemer wordt geacht te weten of te kunnen weten dat onoordeelkundig gebruik van het platform schade kan veroorzaken, waarvoor de Afnemer de aansprakelijkheid draagt, onverminderd het recht van Coaches Rising de schadeveroorzaker buiten de Afnemer om daarvoor aansprakelijk te houden.
Indien Coaches Rising door middel van technische maatregelen de Website en de Online Content heeft beveiligd, is het de Afnemer niet toegestaan deze beveiliging te verwijderen, te wijzigen of te omzeilen.

Artikel 4. Beperking aansprakelijkheid

Coaches Rising en haar gelieerde partijen (inclusief maar niet beperkt tot haar werknemers, directeuren, aangesloten organisaties of andere vertegenwoordigers) kunnen niet aansprakelijk worden gesteld voor verlies of schade die direct of indirect voortvloeit uit uw gebruik (onmogelijk) gebruik van de Website of inhoud, inclusief de faciliteiten of diensten die via deze website worden aangeboden. Aansprakelijkheid voor schade, direct of indirect – inclusief (maar niet beperkt tot) gederfde winst, of inkomen, verlies van gegevens en / of schade als gevolg van claims van derden – wordt niet aanvaard. U vrijwaart Coaches Rising van claims van derden waaronder maar niet beperkt tot partijclaims, claims ten aanzien van verlies of schade (inclusief redelijke advocatenkosten) die voortvloeien uit of verband houden met uw schending van de Algemene Voorwaarden, de Gebruikersvoorwaarden, uw gebruik van de Website of uw schending van rechten van derden. In het geval dat de bovengenoemde uitsluiting van aansprakelijkheid gedeeltelijk of in zijn geheel geen stand houdt, zal de aansprakelijkheid van Coaches Rising en haar gelieerde partijen (inclusief maar niet beperkt tot haar werknemers, bestuurders, aangesloten organisaties of andere vertegenwoordigers) in alle gevallen beperkt zijn tot het bedrag dat de Afnemer heeft betaald voor het gebruik van de Content, met een maximum van $ 900 US Dollars ($900.00).

Artikel 6. Opschorting en beëindiging

Coaches Rising behoudt zich het recht voor om het gebruik van de Website of de inhoud ervan naar eigen goeddunken te beëindigen. Om ervoor te zorgen dat Coaches Rising een hoogwaardige ervaring biedt voor de Afnemer en voor andere gebruikers van de Website en de service, gaat u ermee akkoord dat Coaches Rising of haar vertegenwoordigers toegang heeft tot uw account en gegevens om klachten of beweringen te onderzoeken van misbruik, schending van rechten van derden of ander ongeoorloofd gebruik van de Website. Coaches Rising behoudt zich het recht voor om het bestaan of het optreden van een dergelijk onderzoek niet bekend te maken, tenzij wettelijk vereist. Coaches Rising behoudt zich tevens het recht voor om uw account of uw toegang tot de Website onmiddellijk op te schorten of te beëindigen, met of zonder kennisgeving aan u, als Coaches Rising is van mening dat een van de Gebruiksvoorwaarden is geschonden, wanneer Coaches Rising is voorzien van valse of misleidende informatie, of wanneer het gebruik van de Website door Afnemer voor anderen is

Artikel 7. Overig

Indien enige bepaling van deze Gebruiksvoorwaarden geheel of gedeeltelijk nietig blijkt te zijn, nietig wordt verklaard of anderszins ongeldig blijkt te zijn, wordt de geldigheid van de overige bepalingen van deze Gebruikersvoorwaarden niet aangetast. De bepalingen die niet rechtsgeldig zijn of niet bij wet kunnen worden toegepast, worden vervangen door bepalingen die zo dicht mogelijk bij de strekking van de nietige bepalingen liggen.

Deze site en de inhoud worden uitsluitend weergegeven met het doel de beschikbare services van Coaches Rising te promoten. Op deze Gebruikersvoorwaarden is uitsluitend Nederlands recht van toepassing, ongeacht eventuele wetsconflicten.
